Our Terms & Conditions create a contract between you and PlasmaDan (the “Terms & Conditions”). These Terms & Conditions apply to all products and services offered by us on the https://plasmadan.com website (“Site”). Please read our full Terms & Conditions carefully.

1. Ordering and Payments

1.1 The prices we quote include UK VAT at the relevant rate. If you are based outside the UK the VAT may be zero rated (EU VAT is zero rated from Jan 1st 2021). This is usually calculated automatically at checkout, please contact us if you have problems with this. Our VAT number is GB 163 9265 87.

1.2 Payments are processed externally by Stripe or PayPal. We do not hold any payment information.

1.3 All products displayed on this site are subject to availability and all orders are subject to acceptance.

1.4 All product images displayed on this site for illustration purposes only. Actual product appearance may differ.

1.5 We reserve the right to decline any order, whether or not payment has been received. If we reject or cancel an order for which payment has been taken, we will refund the full amount to you as soon as reasonably practical.

1.6 If you have any problems with your order, please contact us.

2. Availability

2.1 We aim to keep enough stock so that we never run out. However, at times when there is unexpectedly high demand, we may unfortunately run out. If this happens, we may delay sending out your order until we get new stock.

2.2 We may offer to accept orders for out of stock products, which will be shown as available for back-order. These will be processed once the stock is replenished. Payments for back-ordered products will be processed immediately.

3. Delivery

3.1 We use a national courier and in most cases once your order has shipped you will receive it within 2-3 working days (UK), 5-7 working days (EU) or 10-15 working days (rest of the world).

3.2 Ownership of the goods will pass to you upon receipt.

4. Cancellations

4.1 If you want to cancel your order, you can do so at any time until we ship it. You have the right to cancel your order within 14 days. We will cancel your order and issue a full refund (including delivery charges) to the credit card, debit card or PayPal account used to place your order. We will make the refund as soon as possible and within 14 days of cancellation. If we have sent the goods before you cancel your order, you can still get a refund by following our returns procedure.

5. Quality Assurance

5.1 If any of the goods we supply fail to perform satisfactorily due to faulty materials or workmanship, contact us at any time and we will work with you to resolve the problem. This may involve a repair, providing a replacement product or giving you a full or partial refund. Your rights, defined in the Consumer Rights Act 2015, are not affected by these terms.

6. Unexpected Circumstances

6.1 If things like strikes, power cuts, extreme weather conditions, wars, acts of terrorism or any other unexpected circumstances interfere with our business with you, we will do our best to keep things going. However, we will not be legally responsible to you for any failure which is due to these unexpected circumstances or any other situation outside our control.

7. Age Restrictions

7.1 By ordering from our site, you are confirming that you are over 18 and that the person receiving the delivery, or collecting the goods, is also over 18. We can cancel your order if we have good reason to believe you do not meet the relevant age restriction.

8. Copyrights

8.1 All content included on this site such as text, graphics, logos, buttons, icons, and images are owned by us and are protected by international copyright law, subject to the copyright displayed at the bottom of this site, except where 3rd party images may on-occasion be shown on our site for illustration purposes.

9. Legal Responsibility

9.1 Nothing in these terms of business should affect your legal rights or limit our legal responsibility for death, personal injury or fraudulent misrepresentation resulting from our negligence, or any other liability which we cannot limit or exclude by law. This includes our legal responsibility under section 2(3) of the Consumer Protection Act 1987.

9.2 We will not compensate for delivery delays or failures that are outside our control unless you have asked us for a premium delivery option. In these circumstances, we will limit what we pay you to a refund of the additional delivery charges you have paid. We will not be legally responsible to you for any losses which both we and you could not expect at the time you placed the order.

9.3 We shall not be responsible for any delay in, or failure of, performance of our obligations under these conditions arising from any event beyond our control.

10. Consent

10.1 We may use 3rd party services to send follow-up emails, including, but not limited to, order tracking information, review reminders and sales feedback. See Privacy Policy for full details on how we use collected information.

11. Changes to These Conditions

11.1 We have the discretion to update these conditions at any time. When we do, we will revise the updated date at the bottom of this page. We encourage you to frequently check this page for any changes. You acknowledge and agree that it is your responsibility to review these conditions periodically and become aware of modifications.

11.2 Your statutory rights are not affected.
